Kracker-Jack - Conditions of Business

1. Initial enquires can be made via email, telephone or surface mail. Bookings must be accompanied by the appropriate 25% deposit. We are not bound to accept any booking. There will be no contract until the deposit is received and cleared. Telephone/email reservations will be held until the booking information and deposit are received which shall be no longer than ten working days after the reservation.


2. The balance of the fee is payable in full not less than two calendar months before the commencement of the charter. If such balance is not paid when due we will then, without notice to you, deem such non-payment to be notice of your cancellation of the booking.


3. All payments are non-returnable except in the event of cancellation of the charter by us or the preferred yacht being unavailable and there is no suitable replacement. In either of these cases all monies will be returned to the Client. No further liability of any sort shall be attached to us. To avoid cancellation loses we strongly advise you to take out any necessary insurance cover.

4. We reserve the right to change the vessel used on charter if for any reason the vessel advertised is not available.

5. Kracker Jack is insured against accident and third party liability and meets the relevant safety requirements but individual clients are not insured against personal injury, loss or responsibility for cancellation. In your own interest you are strongly advised to insure against these contingencies.

6. In all cases whilst onboard the decision of the skipper shall be final. Whilst every effort is made to give Clients the maximum possible sea time and achieve the mutually agreed itinerary, the skipper will not put to sea if, in his opinion, the weather or other conditions (i.e. crew strengths) render it imprudent and unsafe to do so.

7. If the return of the vessel to its intended destination at the end of the charter is delayed or not achieved for whatever reason, the client shall be fully liable for any excess charges such as additional travel/accommodation costs, delayed flights or onward travel to return home. We strongly advise you to take out any necessary insurance cover.

8. The clients must not themselves or allow any person onboard to commit any act contrary to the laws of the Country in which Yacht Kracker Jack is operating. If such an act is committed the agreement/contract shall terminate immediately without prejudice to any right of the skipper, crew or the owners of the yacht. The client alone shall bare all resulting responsibilities and shall alone answer to the appropriate authorities for any act which is in contravention of the laws of the Country concerned.

9. The following items are NOT included within the price of the charter:

 

• Travel costs associated with joining Kracker Jack
• Immigration fees/visas
• Mooring fees such as marinas and anchorages

• The costs of all food or drinks
• Personal/Travel insurance
